IKN Law is Sued, DPR Respects and Will Defend Constitutional Arguments

Member of Commission II DPR RI Rifqinizamy Karsayuda emphasized that his party respects the constitutional rights of citizens in carrying out a judicial review (JR) lawsuit to the Constitutional Court regarding Law Number 3 of 2022 concerning the State Capital (IKN). Respect for JR’s lawsuit to the Constitutional Court as happened in the Job Creation Law which was also sued to the Constitutional Court and the DPR also accepted the Constitutional Court’s decision.

“In the case of the Constitutional Court’s decision related to the Ciptaker Law, for example, we welcome the Constitutional Court’s decision. Therefore, now in the context of the legislative function of the DPR RI, we are making changes to the Ciptaker Law,” explained Rifqi, Rifqnizamy’s nickname when contacted by Parliament on Wednesday (March 2, 2022).

However, in relation to the lawsuit for the IKN Law, the DPR as the respondent will insist on defending the constitutional arguments, both related to the formation (formal) aspect and related to the substance (material) of the IKN Law which is being sued by the citizens.

“We believe that the IKN Law is constitutional. Because in the preparation we always adhere to the principles of drafting laws and regulations, on the other hand we have also carried out academic studies including comparative studies to then move this IKN, “explained this member of the PDI-Struggle Faction DPR RI.

On the other hand, this member of the Indonesian House of Representatives who came from South Kalimantan also emphasized that the ideals or enthusiasm for moving the IKN did not date back to the era of President Joko Widodo. This desire has emerged in 1957 since the era of President Soekarno, then in the era of President Soeharto, and finally continued during the era of President Susilo Bambang Yudhoyono.

According to Rifqi, this nation must make major breakthroughs in the context of equitable distribution of national development, as well as create a national capital that is more compatible with the needs of today’s era and the future. “That’s what we call Green and Smart City in the context of the Nusantara IKN,” he concluded.

It is known, since the IKN Law was passed by the Indonesian House of Representatives as of January 18, 2022, this law has been sued by JR to the Constitutional Court twice. First, in early February 2022 by the public, although at that time the IKN Law was still waiting for approval from the president and promulgated by the Indonesian Ministry of Law and Human Rights. Second, in early March by the community, after the numbering and the IKN Law was promulgated by the Indonesian Ministry of Law and Human Rights.
